1. Introduction

Welcome to Nola AI Ltd, a company incorporated in England and Wales with registered number 15565119, whose registered office is at 24 Walsingham Dene, Bournemouth, England. By accessing or using our web pages located at trynola.io and the Nola mobile application (together or individually the “Service”) operated by Nola AI Ltd, you agree to be bound by these Terms of Service (“Terms”, “Terms of Service”).

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood these Agreements and agree to be bound by them. If you do not agree with (or cannot comply with) these Agreements, you may not use the Service.

These Terms apply to all visitors, users, and others who wish to access or use the Service.

2. Communications

By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving these communications at any time by following the unsubscribe link or emailing us at hello@touchai.ltd.

3. Purchases and Subscriptions

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply information relevant to your Purchase, including without limitation your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

We use RevenueCat to facilitate in-app purchases and subscriptions. By making a Purchase, you grant us the right to provide your information to RevenueCat and any other third-party services involved in processing your payment. All such services are subject to our Privacy Policy.

You represent and warrant that:

• You have the legal right to use any payment method(s) in connection with any Purchase.
• The information you provide is true, correct, and complete.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price of the product or service, or suspected fraud or unauthorized transactions.

4. Subscriptions and Free Trials

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”) via RevenueCat. Billing cycles are set either on a monthly or annual basis, depending on the subscription plan you select.

At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it. You may cancel your Subscription through your online account management page or by contacting our customer support team.

A valid payment method, such as a credit card or PayPal, is required to process payments. By submitting payment information, you authorize Nola AI Ltd to charge all Subscription fees incurred through your account.

We may also offer a Free Trial period for Subscriptions. If you sign up for a Free Trial, you will not be charged until the trial period ends. If you do not cancel before the end of the Free Trial, you will be automatically charged.

5. Fee Changes

Nola AI Ltd reserves the right to modify Subscription fees at any time. Any fee changes will become effective at the end of the current Billing Cycle. We will provide reasonable notice of fee changes, giving you an opportunity to terminate your Subscription if you do not agree to the new fees.

6. Refunds

Except as required by law, paid Subscription fees are non-refundable.

7. Analytics and Monitoring

8. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• To exploit, harm, or attempt to harm minors.
• To transmit unsolicited advertising or promotional material.
• To impersonate Nola AI Ltd or any other entity.
• To infringe upon the rights of others or engage in unlawful activities.
• To interfere with any other party’s use of the Service.

9. Intellectual Property

The Service and its content are the exclusive property of Nola AI Ltd. You may not use, distribute, modify, or exploit any content without permission.

10. Feedback

You may provide feedback, but we own all rights to your feedback, including the right to commercialize any derivative work.

11. Accounts

When you create an account, you guarantee that you are above 18 and that the information you provide is accurate. You are responsible for maintaining your account credentials.

12. Limitation of Liability

Nola AI Ltd and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

13. Termination

We may terminate your account at any time for any reason. You may discontinue using the Service to terminate your account.
